NISA for Americans (or Japanese-American dual nationals)

It seems the US government is not eager to let Americans have tax-free retirement savings overseas, and at the same time the Japanese government doesn't want to recognize such plans in the USA.
I wonder whether anyone has actually been called out when having such a fund.
Given the limits ($5,000/yr in US, similar in Japan until recently), the total amounts are relatively modest unless someone got very lucky with individual stock picks.
